Have the full legal name of the person you are searching, and a date of birth if you know it. Staff will help you look up case numbers, docket entries, charges, and dispositions. Viewing public records at the counter is free. Paper copies carry a small per-page charge.
You can also request records by mail. Write a letter with the subject's name and date of birth, describe what you need, and include return postage and payment for copy fees. Call (423) 743-3381 before you mail anything to confirm current fees and the mailing address. Responses typically take one to two weeks by mail.
Unicoi County circuit and general sessions cases are searchable through the Tennessee AOC free online case portal. That system lets you search by name and view case numbers, charges, and dispositions for public cases without visiting the courthouse. Results are generally a few days current.
General Sessions Court
General Sessions Court in Unicoi County handles misdemeanor criminal cases, traffic violations, small claims, and preliminary hearings for felony charges. The clerk operates out of the Erwin courthouse. These records are public and accessible the same way as Circuit Court records.
Misdemeanor cases that stay in General Sessions from start to finish are maintained entirely by that clerk. Cases where a felony charge is bound over to Circuit Court transfer to the Circuit Court Clerk. The AOC online portal will show which court a particular case is in, which helps you know which clerk to contact.
Warrant records are also available through the clerk's office. Served warrants are public records. If you need to know whether a warrant exists for a specific person in Unicoi County, asking in person is the most reliable method since not all warrant records appear in online systems right away.
Unicoi County Sheriff's Office
The Unicoi County Sheriff's Office handles law enforcement and runs the county jail in Erwin. Arrest records are public under Tennessee law. Call the Sheriff's Office at (423) 743-3141 to ask about recent arrests or confirm whether someone is currently held at the county jail. Booking records list the name, charge, and date of arrest for each person booked.
Keep in mind that arrest records are not convictions. A person booked into jail may later have charges dismissed or be found not guilty. For the outcome of a case, check with the court clerk or use the AOC online portal. The Sheriff does not conduct employment background checks. Those requests go to the Tennessee Bureau of Investigation.
Unicoi County borders North Carolina, so some law enforcement matters may involve both state and federal agencies. If you are searching for a record that may have crossed state lines, a TBI check may not be enough. In those cases, a federal background check through the FBI may be needed.
Statewide Background Checks Through TBI
The Tennessee Bureau of Investigation provides statewide criminal background checks through the TORIS system. A name-based search covering all Tennessee counties, including Unicoi, costs $29. Submit requests at tbibackgrounds.tbi.tn.gov/Toris/. Results typically return in a few business days and cover felony and misdemeanor convictions in Tennessee courts.
More information on check types, fees, and how to order is at tn.gov/tbi/divisions/cjis-division/background-checks.html. Fingerprint-based checks, which also search the FBI national database, are available for positions that require them. The TBI also maintains the free Tennessee Sex Offender Registry, which can be searched separately.
Public Records Access Under T.C.A. § 10-7-503
Tennessee's Public Records Act at T.C.A. § 10-7-503 guarantees any person the right to inspect public records held by government agencies. Court files and arrest logs held by Unicoi County offices are public records under this law. Agencies must respond within seven business days.
Exempt records include juvenile court files, sealed cases, active investigation materials, and some personnel records. If a request is denied, the agency must state the reason in writing. The Tennessee Office of Open Records Counsel provides free help to anyone who has trouble accessing public records or who receives a denial they believe is improper.
Expungement Under T.C.A. § 40-32-101
Tennessee's expungement statute, T.C.A. § 40-32-101, allows eligible people to remove certain criminal records from public view. Dismissed charges, acquittals, and some low-level first-time convictions after a waiting period may qualify. Violent offenses, sex crimes, and DUIs are generally not eligible.
To file for expungement in Unicoi County, submit a petition to the Circuit Court Clerk in Erwin. A filing fee is required. The judge reviews the petition and, if approved, orders all state agencies to remove or seal the record. The TBI must then update its records. An attorney in the Erwin or Johnson City area can help you assess eligibility and file the petition correctly.
Felony Offender Information Lookup (FOIL)
Tennessee's FOIL database is free and available at apps.tn.gov/foil-app/search.jsp. It shows felony convictions from all Tennessee counties, including Unicoi. Search by name to see the offense, sentencing date, and supervision status. Misdemeanor records and arrests that did not lead to conviction are not in this database.
FOIL is a good free tool for a quick felony check. For a full background check with misdemeanor history or a certified result, use TBI TORIS. The AOC online portal is also free for checking case-level records in Unicoi County.
