Macon County Quick Facts
Macon County Circuit Court Clerk
The Macon County Circuit Court Clerk keeps criminal court records for the county. The clerk's office sits inside the Macon County Courthouse in Lafayette. Staff handles record requests, copy fees, and public access to case files during regular business hours Monday through Friday.
To run a background check through the Circuit Court Clerk, you can go in person or mail a written request to the courthouse. Give the full legal name of the person you are searching. A date of birth helps narrow results and reduces the chance of pulling records for the wrong person. Case numbers speed things up if you already have one. Standard copy fees apply under state law. Certified copies cost more per page. Call the clerk ahead of time to confirm the current fee schedule before you mail a check or money order.
The courthouse has public access terminals where anyone can look up case records for free. This works well for a basic name search. If you need actual documents or certified copies for a legal matter, you have to go through the formal request process at the counter.
You can search Macon County court cases online through the Tennessee Administrative Office of the Courts portal at tncourts.gov. The free search shows case status, charge information, and upcoming court dates. Some older records may not be in the online system, so contact the clerk directly if your search comes up short.
Macon County General Sessions Court
The General Sessions Court in Macon County handles misdemeanor criminal cases, traffic violations, civil matters under the jurisdictional dollar limit, and preliminary hearings for felony charges before they move to Circuit Court. All General Sessions records are public and part of a complete Macon County background check.
Records from General Sessions Court are kept by the clerk's office at the courthouse in Lafayette. If you need to look up a misdemeanor conviction, a DUI, or a traffic-related criminal matter, General Sessions is the right court. The clerk can tell you what you need to bring and what fees to expect for copies. Most requests are straightforward and can be handled same-day at the counter.
Macon County Sheriff's Office
The Macon County Sheriff's Office handles arrest records and incident reports for law enforcement activity throughout the county. A records request with the Sheriff's Office covers Macon County arrests only. It will not show charges from other Tennessee counties or other states. For a full statewide history, you need to go through TBI.
The Sheriff's Office may post a current jail roster or recent booking information online. Check the Macon County Sheriff's website or call the office directly to ask about their public records process. Requests are handled during business hours at the main office in Lafayette. Fees for copies of incident reports and arrest records vary, so ask before you submit a request with payment.
Statewide Background Checks - TBI TORIS
The Tennessee Bureau of Investigation runs the Tennessee Offender Registration and Identification System, known as TORIS, at tbibackgrounds.tbi.tn.gov. This is a name-based statewide search that covers arrests and charges from all 95 Tennessee counties, including Macon. The fee is $29 per search.
TORIS does not pull records from other states or the federal system. If you need a broader check, a fingerprint-based search through IdentoGO connects to the FBI database. Fingerprint searches are more accurate because they do not rely on name spelling and reduce false matches. Most employers and landlords use TORIS for standard Tennessee background check purposes.
You can also mail a request to TBI at 901 R.S. Gass Blvd., Nashville, TN 37216, or reach them by phone at 615-744-4057. Full details on available search types are on the TBI background checks page.
Public Records Access - T.C.A. § 10-7-503
Macon County courts operate under the Tennessee Public Records Act, T.C.A. § 10-7-503. Any Tennessee citizen has the right to inspect public government records during business hours at no charge. Most court records fall into this category. You do not have to say why you want a record or prove any relationship to the person you are searching.
There are exceptions. Juvenile court records are sealed. Some active investigation files are withheld. Cases that a judge has ordered sealed are not available to the public. If a request is denied, the agency must give a written reason. You can appeal a denial to the Tennessee Office of Open Records Counsel. Most routine background check requests in Macon County are handled without issue.
Expungement - T.C.A. § 40-32-101
Tennessee law permits expungement of certain criminal records under T.C.A. § 40-32-101. If a Macon County charge was dismissed, a grand jury returned no true bill, or the person was released without charge, they can petition the court to have those records destroyed at no cost. There is no fee for expunging a dismissed charge.
Conviction expungements are allowed in limited cases. The offense cannot involve physical force, a deadly weapon, or a sex crime that requires registration on the state sex offender list. A waiting period applies depending on the offense class. Petitions for expungement in Macon County are filed with the Circuit Court Clerk in Lafayette. An attorney can help determine eligibility and draft the petition, though it is not required.
Felony Offender Records - FOIL
The Tennessee Department of Correction operates the Felony Offender Information Lookup at apps.tn.gov/foil-app. FOIL is free and open to anyone.
