Name-based searches can sometimes return results for people who share a similar name. Fingerprint-based searches are more precise because they match a specific person's biometric record. Public Records Access in Chester County
Tennessee's Public Records Act, T.C.A. § 10-7-503, gives any Tennessee citizen the right to inspect public government records during business hours. Chester County courts follow this law. You do not need to give a reason for your request. You do not need an attorney. Most background check requests are handled without any trouble.
The law requires that custodians respond to records requests promptly. If you make a written request, the office must respond in a reasonable time. If the office denies your request, they must put the reason in writing. Some records are restricted. Juvenile records are generally closed to the public. Cases that were expunged or sealed are not available. Mental health records and certain victim information are also protected. But standard criminal court records for adults are open.

Under T.C.A. § 40-32-101, certain Chester County criminal records can be expunged. If a charge was dismissed, a grand jury did not indict, or you were released without being charged, you can ask the court to destroy those records. There is no filing fee for this type of petition.
Conviction expungements are available in limited cases. The crime cannot involve physical force, a deadly weapon, or a sex offense that requires registration. FOIL covers anyone who has been processed through the Tennessee Department of Correction, including Chester County residents sentenced to state prison. The search is free and does not require an account. Results are updated within about one week of an inmate entering the system. FOIL is useful when you need to confirm if someone is currently serving a state prison sentence.
Keep in mind that FOIL only shows people currently or recently in the state prison system. It does not show county jail inmates, people on probation, or those who have fully completed their sentences. For a full criminal history, the TBI TORIS search is the more complete option.
